HB 1105 - An Act amending the act of December 20, 1985 (P.L.457, No.112), known as the Medical Practice Act of 1985, further providing for definitions; and providing for certain governmental prohibitions.  The American Medical Association, the American Academy of Pediatrics and the New England Journal of Medicine, have all consistently advocated that without the ability to engage in honest, accurate and candid conversations in the exam room, patient care can be greatly compromised. Unfortunately, there have been a proliferation of recent proposals by state legislatures across the country that would intrude on the patient-provider relationship mandating or otherwise directing how health care providers communicate, interact with, and care for their patients. These proposals are often in direct contradiction with empirical evidence or what is considered appropriate medical care. In worst case scenarios, this type of legislation forces health care providers to choose between their ethical mandate to provide the best possible care and following the rule of law.  The Patient Trust Act was born in response to consistent, unrelenting government intrusions into the exam room.  Specifically, this bill will prevent the Commonwealth and all political subdivisions from requiring a health care practitioner to provide a patient with information that is not medically accurate and medically appropriate for the patient, or providing a medical service that is not evidence based and patient appropriate. Additionally, health care practitioners would not be prohibited from sharing medically accurate information with their patients. This legislation is pro-patient, pro-doctor and a pro-health attempt to reign in legislative over-reach into the examination room and to protect those medically accurate, evidence based treatments and approaches for which physicians - not legislators - are trained to dispense.  Last Actions: PN 2288 Referred to PROFESSIONAL LICENSURE, Oct. 1, 2015.

SB 747 - An Act amending the act of March 20, 2002 (P.L.154, No.13), known as the Medical Care Availability and Reduction of Error (Mcare) Act, further providing for punitive damages; providing for punitive damages study; and imposing duties on the Insurance Commissioner. SB 1013 - An Act amending Title 51 (Military Affairs) of the Pennsylvania Consolidated Statutes, providing for voluntary veterans' preference in private employment.  This bill would allow a private employer to adopt and apply a veterans’ employment policy which would need to: be in writing, include a statement an employer has and applies a preference in a job posting, be provided to an applicant upon hire and all employees annually; and be applied uniformly.  The bill would exempt an employer who has adopted and applies a policy in compliance with the act from violations of State and Local equal employment opportunities law.  For purposes of this act, a veteran would include surviving spouses and a spouse of a disabled veteran.  This bill would leave the decision whether or not to adopt a policy solely up to an employer.  There would be no mandate on an employer to have a veterans’ preference.   Allowing private employers to adopt a veterans’ preference has been signed into law in a number of states including: California, Florida, Georgia, Kentucky, and Oklahoma.  Last Action: PN 1309 Referred to VETERANS AFFAIRS AND EMERGENCY PREPAREDNESS, Oct. 9, 2015.

SB 1025 - An Act amending the act of April 9, 1929 (P.L.177, No.175), known as The Administrative Code of 1929, establishing the Office of State Inspector General.  Currently, the Inspector General is a cabinet-level official who is appointed by, and reports to, the Governor.  Pennsylvania is among a small minority of states that does not have a separate statute providing for the appointment, term and duties of the Inspector General.  Currently, the office only exists if the Governor wishes it to continue by Executive Order.  This legislation would create, by law, this important post and provide that the Inspector General be nominated by the Governor and confirmed by two-thirds of the Senate.  Under this bill, the Inspector General would serve a term of 6 years and could serve no more than 2 terms.   The goal is to create this office in a manner that will allow our Inspector General to work independently from the influence of any one Governor, who now can unilaterally direct the detection of waste, fraud and abuse in state government.   Last Action: PN 1311 Referred to STATE GOVERNMENT, Oct. 9, 2015.

SB 1039 - A Joint Resolution proposing an amendment to the Constitution of the Commonwealth of Pennsylvania, further providing for exemptions and special provisions.   Would expand the Property Tax Exemption Program for Disabled Veterans.  Currently, an honorably discharged disabled veteran must be 100 percent disabled and have a financial need to receive a 100 percent exemption from property taxes.  This Constitutional Amendment would exempt additional honorably discharged disabled veterans from paying a portion of their property taxes.  The amount of the tax exemption would depend on the extent of the veteran’s disability, as determined by the U.S. Department of Veterans Affairs.  If a veteran is determined to be 100 percent disabled, he or she would be exempt from paying property taxes; a veteran considered 75 percent disabled, would be exempt from paying 75 percent of his or her property taxes.  A fifty percent disability would be the threshold.  Additionally, all veterans - whether 50 percent or 100 percent disabled - would still have to qualify based on their financial need.  Last Action: PN 1332 Referred to VETERANS AFFAIRS AND EMERGENCY PREPAREDNESS, Oct. 20, 2015.

The legislation would reduce that figure from 50 percent to 40 percent, in part to fund a 401(k)-like defined-contribution Thrift Savings Plan for the more than eight in 10 service members who leave the military without getting any retirement benefit.  The so-called blended retirement plan would also let a service member take part of his retirement pay as a lump-sum payment after 12 years of service and after 20 years. The overhaul wouldn't take effect until 2018 "to allow DoD and relevant stakeholders time for implementation," the summary states.  Unfortunately the bill also includes a troop pay raise of only 1.3 percent rather than 2.3 percent for next year.  The Pentagon proposed the lower figure, which compares to a 1 percent bump in basic pay service members received the past two years. But it's less than the 2.3 percent estimated increase in private-sector wage growth (Employment Cost Index), which military pay is supposed to track by law.  Lawmakers rejected proposals to overhaul the military commissary system and ordered the Defense Commissary Agency to plan for making the system self-funded by 2018.  They asked officials to submit a report by March 1 on how the commissary, which receives $1.4 billion a year in taxpayer funding, could find savings by privatizing operations, working with grocers to provide military discounts, closing stores or combining the commissary and exchange systems.
