HB 1105 - An Act amending the act of December 20, 1985 (P.L.457, No.112), known as the Medical Practice Act of 1985, further providing for definitions; and providing for certain governmental prohibitions.  The American Medical Association, the American Academy of Pediatrics and the New England Journal of Medicine, have all consistently advocated that without the ability to engage in honest, accurate and candid conversations in the exam room, patient care can be greatly compromised. Unfortunately, there have been a proliferation of recent proposals by state legislatures across the country that would intrude on the patient-provider relationship mandating or otherwise directing how health care providers communicate, interact with, and care for their patients. These proposals are often in direct contradiction with empirical evidence or what is considered appropriate medical care. In worst case scenarios, this type of legislation forces health care providers to choose between their ethical mandate to provide the best possible care and following the rule of law.  The Patient Trust Act was born in response to consistent, unrelenting government intrusions into the exam room.  Specifically, this bill will prevent the Commonwealth and all political subdivisions from requiring a health care practitioner to provide a patient with information that is not medically accurate and medically appropriate for the patient, or providing a medical service that is not evidence based and patient appropriate. Additionally, health care practitioners would not be prohibited from sharing medically accurate information with their patients. HB 1403 -  An Act amending Title 40 (Insurance) of the Pennsylvania Consolidated Statutes, providing for unclaimed life insurance benefits.   Bill would require insurance companies to match Death Master File records, or an equally comprehensive service, with in-force life insurance policies on a semiannual basis.  It also calls for timely effort by an insurance company to confirm a policyholder’s death, locate any beneficiaries, and provide claims forms or instructions.  In the event that benefits go unclaimed, the legislation provides clear procedures for life insurance companies to notify Pennsylvania’s Treasury Department and escheat the funds, per our state’s unclaimed property laws.   It is not uncommon for the beneficiary of life insurance policy to be unaware that a policy is in place.  The beneficiaries deserve to receive that money in a timely fashion, not years later when it may have lapsed into Unclaimed Benefits. HB 1607 - Joint Resolution proposing separate and distinct amendments to the Constitution of the Commonwealth of Pennsylvania, further providing for terms of members and for the Legislative Reapportionment Commission.  The proposal would increase the length of the term for a Representative in the General Assembly to four years and place half of the House districts on the ballot for election every two years.  Representatives would be limited to three successive terms for a total of 12 years of service.  Additionally, the Senate would see the length of its terms increased to six years.  Senators would be limited to two successive terms for a total of twelve years of service.  By extending terms, the legislation seeks to improve the efficiency of the General Assembly by eliminating the constant election cycle for members of the House of Representative.  In addition, the legislation imposes term limits in order to ensure that the makeup of the General Assembly is representative of the changing population of the Commonwealth.   Last Action: PN 2325 Referred to STATE GOVERNMENT, Oct. 8, 2015.

HB 1615 - An Act prohibiting certain conduct in public office; and prescribing penalties. Under this proposal, abuse of office would be a criminal offense if an elected official, public officer or public employee would (1) intentionally compel a public employee to perform an activity knowing the activity is not related to the performance of the duties of the office held by the elected official or public officer and (2) intentionally compel a public contractor to provide a good or service for the private pecuniary benefit of the elected official, public officer or another person.  A violation would constitute a misdemeanor of the second degree.  However, if the aggregate value of the activities, goods or services performed would exceed $2,000, a violation would be a third degree felony.  A person who falsely reports an alleged violation would also be subject to criminal prosecution.  Last Action: PN 2331 Referred to STATE GOVERNMENT, Oct. 8, 2015.
